These Terms of Service ("Terms") govern your use of Upscale Whale, a macOS application ("App") developed by Light Horse LLC ("we," "us," or "our").
1. Acceptance
By downloading or using Upscale Whale you agree to these Terms. If you do not agree, do not use the App.
2. License
We grant you a personal, non-transferable, non-exclusive license to use Upscale Whale on macOS devices you own or control. You may not resell, sublicense, or distribute the App or its components.
3. Free Tier
Upscale Whale includes 5 free renders at no cost. No account or payment information is required to use the free tier.
4. Paid License
Purchasing an Upscale Whale license grants you unlimited renders on a single device. This is a one-time purchase — there are no recurring charges or subscriptions.
5. Permitted Use
You may use Upscale Whale for personal and commercial projects. You may not reverse engineer, decompile, or modify the App.
6. Disclaimer
Upscale Whale is provided "as is" without warranty of any kind. We do not guarantee specific output quality or processing speeds. AI upscaling results may vary depending on source material.
7. Limitation of Liability
Light Horse LLC shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App.
8. Changes
We may update these Terms at any time. Continued use of the App constitutes acceptance of updated Terms.
